Please read these Affiliate Terms and Conditions carefully before participating in the Zillionheirs Affiliate Program. By registering for, accessing, or participating in the Zillionheirs Affiliate Program, you agree to these Affiliate Terms and Conditions. If you do not agree, you must not participate in the program.
To participate, you must complete the registration process and provide accurate, complete, and current information. The Company reserves the right to approve, reject, suspend, or restrict any application at its discretion, subject to applicable law. Affiliates must be legally eligible to participate and are responsible for maintaining accurate account and payment information. Approval does not guarantee continued participation or any specific level of earnings.
Affiliates agree to promote Zillionheirs and its Products honestly, professionally, and lawfully. You are responsible for complying with all applicable laws, advertising regulations, platform rules, and Federal Trade Commission (FTC) endorsement and disclosure requirements. You must clearly disclose your affiliate relationship whenever required, including in social media posts, videos, livestreams, emails, and other promotional content. You may not make false, deceptive, unsupported, or misleading statements about the Company's Products, features, pricing, results, or earning potential. You may not guarantee sales, income, business growth, or specific outcomes.
Affiliates earn commissions only on qualifying purchases attributed to their unique affiliate links, according to the commission rates, eligibility requirements, and payment procedures communicated by the Company or its authorized payment platform. All commissions are subject to verification and approval. A sale may be excluded if it is fraudulent, self-referred where prohibited, duplicated, canceled, refunded, charged back, or otherwise ineligible under the applicable commission rules. Commissions will be payable according to the applicable payment schedule and platform requirements after the customer payment has been successfully processed and any applicable holding or verification period has passed. The Company may reverse commissions associated with refunds, chargebacks, fraudulent transactions, or other ineligible sales, to the extent permitted by law and the applicable payment platform's rules. The Company may update commission rates and program rules prospectively by providing notice. Changes will not retroactively eliminate commissions already earned under the previously applicable terms, except for reversals permitted under these Terms or applicable law. Affiliates are responsible for their own taxes, required reporting, and any fees associated with receiving payments. No earnings are guaranteed. Results depend on individual promotional efforts, audience engagement, customer demand, and other factors.
Approved affiliates may receive a unique referral link or other tracking method. Affiliates are responsible for using their assigned links correctly and following the Company's tracking instructions. The Company is not responsible for lost attribution caused by incorrect links, unauthorized link modifications, browser restrictions, customer actions, platform outages, or other technical issues outside its reasonable control. Affiliates may not manipulate tracking systems, create fraudulent referrals, use bots to generate clicks or sales, or interfere with another affiliate's attribution.
Affiliates may not: Engage in fraud, spam, deceptive marketing, or misleading advertising. Purchase their own Products through their affiliate links to generate prohibited commissions. Use fake accounts, bots, fabricated leads, artificial engagement, or unauthorized incentives to generate referrals. Make unauthorized promises, guarantees, discounts, or representations on behalf of Zillionheirs. Impersonate the Company or suggest an official partnership, endorsement, or employment relationship that does not exist. Use paid advertisements containing the Company's trademarks or brand terms in prohibited ways, or direct advertisements to the Company's brand terms, unless expressly authorized. Violate third-party intellectual property rights, privacy rights, platform rules, or applicable law. Engage in conduct that damages the Company's reputation or compromises the security of its Products or systems. Violations may result in suspension, termination, commission withholding or reversal where permitted, and other remedies available under applicable law.
The Company grants approved affiliates a limited, non-exclusive, non-transferable, revocable license to use authorized logos, trademarks, product descriptions, and promotional materials solely to promote the Company's Products in accordance with these Terms. Affiliates may not modify protected brand assets without permission, register confusingly similar domains or social media accounts, claim ownership of Company intellectual property, or use Company materials outside the scope of this license. All intellectual property rights remain with their respective owners. The Company may revoke permission to use its materials at any time.
Affiliates retain ownership of original content they create unless a separate written agreement states otherwise. Affiliates grant no broader license to the Company through these Terms alone. Any additional permission to use affiliate-created content in advertisements, emails, websites, social media, or other marketing materials must be documented in a separate written agreement or content release. Affiliates must ensure they have the necessary rights and permissions for all content they publish and may not falsely represent personal experiences, testimonials, or product results.
The Company may suspend, restrict, or terminate an affiliate account for violations of these Terms, suspected fraud, unlawful activity, brand misuse, security concerns, or other legitimate program-related reasons, subject to applicable law. Upon termination, affiliates must stop using their referral links and cease representing themselves as active Zillionheirs affiliates. They must discontinue use of Company promotional materials and remove unauthorized brand references. Any outstanding commissions will be reviewed under the applicable commission rules. Valid, earned commissions will be handled according to these Terms, applicable law, and the relevant payment platform's requirements.
To the maximum extent permitted by applicable law, the Company will not be liable for indirect, incidental, special, consequential, or punitive damages arising from participation in the Affiliate Program. The Affiliate Program and Products are provided subject to their applicable terms and availability. The Company does not guarantee uninterrupted access, specific sales volumes, affiliate earnings, or particular business outcomes. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
Affiliates must protect nonpublic, confidential information received through their participation in the program and may use it only for authorized program purposes. Confidential information may include nonpublic business plans, private customer information, unpublished product information, internal processes, and nonpublic commission arrangements. This obligation does not apply to information that becomes publicly available through no breach of these Terms, was lawfully known to the affiliate, or must be disclosed by law. Affiliates may make legally protected disclosures to regulators or other authorized parties.
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law principles. Subject to applicable law, disputes arising from these Terms will be brought in the state or federal courts located in North Carolina that have jurisdiction over the dispute, and the parties consent to that jurisdiction. Nothing in this section limits any rights or remedies that cannot legally be waived.
The Company may update these Terms or modify the Affiliate Program as reasonably necessary, subject to applicable law. Material changes will be communicated through an appropriate method, such as email, an affiliate dashboard, or a notice on the Company's website. Changes will apply prospectively from their stated effective date unless otherwise required or permitted by law. Continued participation after the effective date constitutes acceptance of the revised Terms where legally valid. Affiliates who do not agree must discontinue participation.
To the extent permitted by applicable law, affiliates agree to indemnify and hold harmless Zillionheirs and its officers, employees, representatives, and agents against third-party claims, losses, liabilities, damages, and reasonable legal expenses arising from the affiliate's unlawful promotional activities, infringement of third-party rights, fraud, or material breach of these Terms. The scope of this obligation will be limited to the extent the claim results from the affiliate's conduct and will not apply to losses caused by the Company's own conduct where prohibited by law.
Affiliates participate as independent parties and are not employees, agents, franchisees, partners, or joint venturers of Zillionheirs. Affiliates have no authority to enter contracts, make binding commitments, or incur obligations on behalf of the Company. Affiliates are responsible for their own business expenses, taxes, and promotional activities.
These Terms constitute the agreement governing participation in the Affiliate Program, together with any separate written agreements that expressly apply to the affiliate relationship. If any provision is found unenforceable, the remaining provisions will continue in effect to the extent permitted by law. Failure to enforce a provision does not waive the right to enforce it later.
